I have to say, this thing with Dave has gotten completely out of hand. It's none of my business, and I've tried hard to keep out of it, but the simple fact that John Reese was "hired to gather evidence" for Dave is just further proof of his ignorance.
I don't know if Dave was informed of the charges and possible penalties. As a first offense and a fairly small charge, I can't imagine this hurting anything but his pride. HE very clearly stated that he didn't remember anything, but said Michelle wouldn't lie...so why has John been hired to defend him? Clearly, he did somethng wrong, wether he knew it or not, and he should be accountable. If he KILLED michelle in her sleep and didn't remember it, would THAT hold? No, it wouldn't. John is making this entire situation far more intense than it needs to be. Not only that, but whatever "rift" there was in the group is only broading because of his gestapo intimidation tactics.
I spoke to my next door neighboor, who is a retired Defense Attourney. Sgt. Reese has very little ground to stand on. First, there is no evidence to gather. Second, charecter witness will probably NOT be employeed in a case of this magnitute. Third, he's threatened to counter sue michelle for charecter defimation....that's when someone has no reason to bring you up on charges. Clearly, michelle has reasons, and there by the threat of a lawsuit only makes john look like a bigger fool, and dave even that more petty. fourth, by dragging this out, instead of Dave simply pleading guilty and taking his slap on the wrist, he's making everyone even MORE aware of the situation, making it MORE volitale and emotional....
seriosuly, i had sympathy for Dave at first, despite the fact that I think he was did it and perhaps lying. Well, there's very little left at this point, after all this garbage....
i sympathize with michelle. however, i also think she is grossly misinformed. she absolutly HAS to know whats going on: what charges dave has been brought up on, what happens from here, what penalties he faces.... in no way, shape or form should she drop the charges -- this shit needs to stick. on the other hand, no one wants to see anything happen to dave except an strike on his record and some forced counseling (counseling not employed by sgt reese at sunday night gaming group).
i told michelle i would take her down to schenectady police station, with my neighboor, and start throwing my name around. there are still plenty of high ranking officers that remember and respected my dad -- any of which would be more than happy to help with this. as long as michelle is informed, then reese cant intimidate her -- she HAS to know what her right are, though, and what dave's are.... this garbage that reese is spreading around is CLEARLY bullshit and is only making things much worse and much more dramatic than they have to be....
i guess thats typical of the group, but this is serious shit, adn the boys need to take a vacation from never-never land and grow up for tink's sake. seriosuly, if any of you guys are reading this, think about how completely ABSURD this situation with john reese is -- he's doing nothing but trying to scare and intimidate everyone, hoping THEY will eventually force michelle to back down... think seriosuly about the law, and how it works, and the consequences for dave.... if he just pleads guilty, he will have strike one on his record, he will recieve counseling, and maybe sentenced to something as horrible as community service. if michelle drops the charges, as reese wants her to, then nothing happens. nothing changes, nothing is dealt with...as usual, no one matures. the group sticks up yet again for one of its boys, due in some ways, perhaps, to loyalty, but mostly for love of drama and PURE IGNORANCE.....
GROW UP. let mr nicklaw reep what he has sewn, and let everyone else stay the fuck out of it. it is between michelle and dave, though truly mostly dave -- the ball rests soley in his court... if he keeps using reese to perpetuate this, its will only make things a hundred times worse for him in the end.... HE needs to stop it before it goes any further.
